Description

The force with which the Italian state defends the presence of the crucifix in public spaces might lead one to believe that the personal use of symbols of other religions is not as well received. After approaching the Italian system of church-state relations, our study sought to answer that question, through the analysis of the issues that have triggered further discussion or that, unlike what happens in other legal systems, have not caused none. Special attention is dedicated to the use of veils in public places. The examination of numerous bills to ban generally its presence in this area is useful to assess the constitutional feasibility of a such a measure. On the other hand, unlike what occurs in comparative law, the lack of any conflict regarding the use of the hijab in school and, conversely, the expressions of support for voluntary use by successive governments, is surprising. Other situations over which this work focuses are the employment of burqini in pools or similar places, as well as the use of different religious signs, especially headdresses, while driving, in photographs of official identity documents, in courts and airport security controls, at the labor sector, for oaths or in prisons.
